Learning Contract

1. General Provisions

1.1. This Leaning Contract is an official contract of the Online Language School Cosmopolitan Open Knowledge Institute COKI (hereinafter referred to as the “Contractor”) and contains all the essential terms and conditions for the provision of online services for teaching foreign languages.

1.2. In accordance with paragraph 2 of Article 437 of the Civil Code of the Russian Federation (CC RF), in the event of acceptance of the terms and conditions set out below (acceptance of the Contract), an individual accepting this offer becomes the Client (hereinafter referred to as the “Customer”).

2. Subject of the Contract

2.1. The Contractor undertakes to provide online educational services for the study of one or more foreign languages, and the Customer undertakes to pay for these services.

3. Rights and Obligations of the Parties

3.1. The Contractor undertakes to:

3.1.1. Provide online services efficiently and on time with an experienced teacher.

3.1.2. Provide the Customer with the necessary online training materials on the Contractor's online platform.

3.1.3. Inform the Customer about the schedule of his online classes, provide a report on the work performed and the progress made by the Customer.

3.1.4. Provide a certificate to the Customer who has successfully completed the Program.

3.2. The Customer undertakes to:

3.2.1. Comply with the Contractor's policy regarding access to the online Program and returns in accordance with paragraph 4.2. of this Contract.

3.2.2. Comply with the Contractor's policy regarding the cancellation of classes and being late for them in accordance with paragraph 4.3. of this Contract.

3.2.3. Not use the materials for commercial purposes, including resale, lease or transfer of materials to third parties on a paid basis.

3.2.4. Respect the copyright, intellectual property and related rights of the Contractor to the materials paid for under this Contract.

4. Cost of services and payment procedure

4.1. Cost

4.1.1. The cost of online educational services and the payment procedure are established by the Contractor and can be changed unilaterally with prior notice to the Customer.

4.2. Access to the online Program and refund

4.2.1. The Customer will receive access to the online Program paid for by him within a maximum of 48 hours after its payment.

4.2.2. The Customer has the right to submit an application to the Contractor's support service for a refund for the online Program no later than 7 calendar days from the date of payment for the online Program.

4.2.3. After receiving the application for a refund and confirmation of the legitimacy of its request, the Contractor will refund the funds to the account specified by the Customer within 30 business days from the date of the Customer's submission of the corresponding request.

4.3. Cancellation of classes and lateness

4.3.1. The Customer has the right to cancel a scheduled lesson no more than 2 times a month, notifying their teacher by email at least 24 hours before the scheduled lesson. Otherwise, the Contractor has the right to deduct 100% of the payment for the cancelled lesson from the Customer's balance.

4.3.2. The Customer is obliged to arrive for the online lesson on time. If the Customer is more than 10 minutes late for an online lesson or fails to show up for a scheduled online lesson, the lesson will be cancelled, and the Contractor has the right to deduct 100% of the payment for the cancelled lesson from the Customer's balance.

4.3.3. The Contractor has the right to cancel a scheduled online lesson no more than 2 times a month, notifying the Customer by email at least 24 hours before the scheduled online lesson. Otherwise, the Contractor undertakes to provide the Customer with one additional free online lesson at a time convenient for the Contractor and the Customer.

4.3.4. The Contractor undertakes to provide the online service on time in accordance with the Program paid by the Customer. If the teacher on the Contractor's side is late for an online lesson by more than 10 minutes or fails to appear for a scheduled online lesson, the lesson will be cancelled, while the Customer has the right to reschedule the lesson or request the Contractor to provide one additional free online lesson at a time convenient for the Contractor and the Customer.

5. Liability of the Parties and Dispute Resolution

5.1. The Parties shall be liable for failure to perform or improper performance of their obligations under this Contract in accordance with the current legislation of the Russian Federation.

6. Final Provisions

6.1. This offer shall enter into force upon its acceptance by the Customer and shall remain in effect until the Parties fulfill their obligations.

6.2. For all matters not regulated by this offer, the Parties shall be guided by the current Civil Legislation of the Russian Federation.

• Register online as a student, place an order for our services.
• Voluntarily complete the online application for a teaching position.
• Provide us feedback on any messages by COKI or by sending us your message via email and or other social media message platforms. 

Cookies

Due to the fact that we use third-party applications, such as:  Zoom, Calendly, Godaddy; we assume that you by pursing your visit with us accept all cookies from the third party applications in terms of your personal data. For further clarification, please refer to the privacy policies of Zoom, Calendly and Godaddy in order to better understand how they handle your data.

Data usage

The personal data we collect is used solely for the following purposes:

• Internal administration (process your order, manage your account).
• Marketing purposes within the institute (sending you messages about special offers on our services). 

We do not sell, rent, give or share your personal data with any external parties.

Third-Party sharing

We do not share your personal data with third-party entities, except for the necessary use of third-party applications mentioned above.

Data security

We implement appropriate technical and organizational measures to protect your personal data from unauthorized access, loss, or misuse.

Under current U.S. and EU regulations, you have the right to:
